This document forms the standard Terms and Conditions published on the Rey Living Group website and referenced in every Booking Confirmation. It is provided as a working draft for review — Rey Living Group and its client recommend independent legal review before publication.
These Terms and Conditions (this “Agreement”) constitute a legally binding agreement between the person or company named as the guest on the relevant Booking Confirmation (the “Guest”, “you”) and Rey Living Group, acting as rental agent (“Rental Agent”, “we”, “us”, “our”) on behalf of the property owner or manager (the “Supplier” or “Host”). By confirming a booking, the Guest agrees to rent the residential property identified in the Booking Confirmation (the “Property”) for the period stated in the Booking Confirmation (the “Rental Term”), in consideration of the total rental fee stated in the Booking Confirmation (the “Total Rental Fee”) and the other good and valuable consideration described in this Agreement.
The Guest agrees that no more persons shall occupy the Property at any time during the Rental Term than the maximum number of guests stated on the Booking Confirmation, all of whom shall comply with the conditions and restrictions imposed on the Guest under this Agreement.
The Property is provided on an “as is” basis. Rental Agent shall use its best efforts to ensure the proper operation of all amenities at the Property, such as internet access, satellite or cable TV, hot tubs, and fireplaces, where applicable. Rental Agent shall not be held responsible for the failure of such items to work but will make every reasonable effort to correct any reported issues as quickly as possible. The Guest acknowledges that the use of amenities such as hot tubs, pools, spas, fireplaces, and decks may be potentially dangerous and may involve risk if used improperly, particularly in relation to children, and that such use is entirely at the Guest’s own risk.
The Guest agrees to use electricity at the Property only for normal residential activities using standard appliances.
The Guest shall use the Property for residential purposes only, shall act in a careful manner to prevent damage or loss to the Property, and shall keep the Property in a clean and sanitary condition at all times. The Guest and any additional permitted guests shall refrain from loud noise and shall not disturb, annoy, endanger, or inconvenience neighbours, nor use the Property for any immoral, offensive, or unlawful purpose, nor violate any law, association rule, or ordinance, nor commit waste or nuisance on or about the Property.
If the Guest fails to comply with the conditions and obligations of this Agreement, the Guest shall surrender the Property, remove all of the Guest’s property and belongings, and leave the Property in good order and free of damage. No refund of any portion of the Total Rental Fee shall be made in these circumstances, and if any legal action becomes necessary, the prevailing party shall be entitled to reimbursement from the other party for all costs reasonably incurred.
The Guest shall not assign or sublease the Property, nor permit its use by any person who is not a family member or permitted guest of the Guest within the number of occupants permitted under this Agreement.
All personal property, furnishings, personal effects, and other items brought onto the Property by the Guest or their permitted guests and visitors are at the sole risk of the Guest as regards theft, damage, destruction, or other loss, and Rey Living Group shall not be responsible or liable for any such loss for any reason whatsoever.
The Guest agrees to indemnify and hold harmless Rey Living Group and its agents, owners, successors, employees, and contractors from and against all costs, damages, liabilities, claims, legal fees, and other actions arising from any claim relating to damage to property, injury to persons, or loss of life sustained by the Guest or the Guest’s family and visitors in or about the Property, however incurred, and the Guest expressly agrees to save and hold Rey Living Group harmless in all such cases.
The Guest waives and releases any claim against Rey Living Group, the Property owner, and their successors, assigns, employees, or representatives, for any injury or death sustained by the Guest on, near, or adjacent to the Property, including in relation to any common facilities, activities, or amenities. The Guest agrees that any such facilities or amenities are used entirely at the Guest’s own initiative, risk, and responsibility.
Rey Living Group reserves the right to enter the Property at reasonable times and with reasonable advance notice for the purpose of inspecting the Property or showing it to prospective purchasers, renters, or other authorised persons. Where Rey Living Group has a reasonable belief that there is imminent danger to any person or to the Property, it may enter without advance notice.
If the Property is unavailable for use during the Rental Term for reasons, events, or circumstances beyond the control of Rey Living Group, Rey Living Group will use due diligence and good faith efforts to locate a replacement property that equals or exceeds the Property in occupancy capacity, location, and value, to the reasonable satisfaction of the Guest. Where no such replacement property can be found and made available, Rey Living Group shall promptly refund all payments made by the Guest, at which point this Agreement shall terminate and neither party shall have any further obligation or liability to the other under it.
The following additional terms apply alongside the standard terms above.
This Agreement contains the entire agreement between the parties in relation to the rental of the Property. Any change, amendment, or modification is void unless made in writing and signed by both the Guest and Rey Living Group. References to “Rey Living Group” and “Guest” include their respective heirs, successors, and representatives. A waiver of, or failure to enforce, any breach or provision of this Agreement shall not be treated as a waiver of that or any other provision in respect of any subsequent breach. If any provision of this Agreement is held invalid, the remainder shall not be affected. Any notice required under this Agreement shall be given in writing to the contact details set out in the Booking Confirmation. This Agreement may be signed in one or more counterparts, each an original, which together constitute one instrument, and a digital signature shall be treated as a valid signature.
Cancellations made 14 days or more before the scheduled check-in date will receive a 100% refund of the Total Rental Fee, less any non-recoverable processing or administrative fees. Cancellations made between 14 and 7 days before the scheduled check-in date will receive a 50% refund of the Total Rental Fee. Cancellations made fewer than 7 days before the scheduled check-in date are strictly non-refundable, and the Guest shall forfeit the full Total Rental Fee.
The Guest shall not re-sell, re-assign, sublet, or otherwise transfer this booking to any other person or party without the prior written approval of the Supplier.
The Guest authorises Rental Agent to charge the payment card on file for any damage, missing items, excessive cleaning, smoking violations, or other costs incurred as a result of the Guest’s failure to comply with this Agreement, including replacement and repair costs and standard smoking violation fees of up to £200. Rental Agent will provide an itemised receipt for any such charge.
The Guest consents to Rental Agent and the Supplier collecting and processing personal data in accordance with applicable law and their respective privacy policies. This may include nationality and passport details, and the sharing of data for tax or legal purposes. Payment card information is processed securely by a PCI-compliant third-party service.
Complaints arising during the rental period should first be raised with the Supplier’s staff for resolution. Unresolved issues may be escalated as a formal written complaint to the Supplier. Complaints relating solely to Rental Agent’s booking services may be submitted in writing to Rental Agent, who will respond within 2 business days.
Rental Agent shall not be liable for incorrect information, for disruption caused by force majeure events, or for any consequential or indirect damages. The Supplier’s total liability is limited to the rental cost paid, except for damage caused by negligence, which is limited to reasonably foreseeable losses.
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
Governing law: this Agreement is governed by the laws of England and Wales.
